    Default Debt owed by a person with a similar name

    My wife of 25 years has started getting collections calls and letter for a 2001 debt incurred apparently by a woman with a similar name. We have informed the callers and the agency in writing that she has never lived in Houston (where ther debt apparently orginated) and that her name while similar is not the same. None of the other particulars correspond, like date of birth and social security number. We continue to get mail to pay this debt, though thankfully the calls have stopped. How can we get this time consuming and annoyning collection behavior to stop and is there any chance it will affct our credit?

    My response:

    Since the calls have stopped, then merely throw out the mail. The United States Supreme Court has already decided that junk mail is not an actionable intrusion. It's a short distance between your mailbox and your trashcan.

    No, without the correct SSN, it cannot, and will not, affect her credit rating.

    You can request that they stop contacting you under the Fair Debt Collection Practices Act. There's a sample letter here, although you would have to modify it to fit the circumstances of your case.

    No collection agency wants to contact the wrong party. It is a waste of time and money. If the manager new that you told the collector that they had a wrong party and the collector did not stop the auto letters from going he would be pissed. Don't worry nothing bad will happen to you.
