My question involves an eviction in the state of: MA
My situation is a little confusing, I will try my best to sum it up quickly and accuarately. We signed a lease in Jan 2010 valid until Dec. 2010. In Dec. he called asking us if we wanted to buy the property, we declinded. Then he raised the rent $50 a month and said lets just leave the lease be and do a month to month, which we were OK with. Now last month we find out that the house is in preforeclosure process and he admitted it. We go through a managment property, the owner of the home is overseas. When we have asked him to fix things, like the unsanitary carpet he declinded, as well as electrical issues, he declinded stating that the owner "had no money" and she already "owes him money". We found a new rental and are moving in July 1st and I called and told the management property of our 30 days and told him to use our security deposit as last months rent and I will mail the $50 difference. He refused and sent us a nasty letter. My father co signed for the property and neither of us realized the lease was "Self Extending". And he told my father we had to pay until Dec. 2011 when he told me verbally leave it be and have it be month to month which we assumed. (I learned to read a lease very thouroughly now! never heard of a self extending lease). He is threatening to take us to court, make us pay his atty fees (lease stated), and all this other nonsense. The letter was rude and abbraisive stating that this will be a costly mistake for us to make and will effect our credit ratings and so forth. I am going to have the Board Of Health come out and inspect the house because I know he will find problems, their is mold in my bedroom, potential lead paint (lots of painting chipping and its a VERY old home), the circuit breaker blows if we have the certain things on at the same time ...poor poor electrical, the carpet is the original of the home and is disgusting, it was bad when we moved in but it has worsened now over time and the if you spill something nothing gets it out!!!! My son has asthma and cannot be around mold especially where he is fighting Pneumonia right now. My reason for writing is do you think he would win in court? Do we have a case potentially against him? And now the sewer is going to start getting backed becaue the toilets bubbling and it wont be long and I know he wont fix it. He had a new hot water tank put in last summer ( only runs hot water for 9 min, and not anylonger because this was primarily a beach house ) and it caught on fire two months ago !! I called him and told him of no water and a funny smell and he came over while i was at school and said "Oh the switch needed to be pushed your all set", My husband came home checked it and still no hot water, then he opened up the hot water tank and found the installation caught on fire!!! Hes really turning into a slum lord. We used Junes rent and put it on a deposit on another much cleanlier and better rental which is why i asked for him to use security deposit as lasts . We also just found out the foreclosure is happening July 11, 2011.
