My question involves court procedures for the state of: NY.
There were two officers involved in my traffic ticket: witnessing officer and the issuing officer. The issuing officer didn't personally witness the alleged offense because he was 200+ feet further down the road around a bend.
Let's say that only the issuing officer shows up and the trial starts. When this officer says that the other officer told him about the alleged offense I can say this is hearsay. Now the prosecutor has no case.
Can the prosecutor, realizing he should have the other officer in court, ask the judge for a continuation so that he can get the other officer in at another time?
Can I object to this request since the trial has already started?
