    Question What Can I Do About More Visitation and Transportation

    My question involves a child custody case from the State of: Virginia

    We had custody and visitation done last year knowing I had a pending 3rd DUI charge. I took whatever I could get to make sure I saw my daughter. I am about to finish my incarceration and would like to look into overnight visitation and the ability to travel with her(currently not allowed to make decisions on transportation. I undeerstand there definitely needs to be some time for her(my daughter) to transition but would still like to see what can be done about these issues. I will have my own apartment and have been active in recovery regarding my alcohol issues. I would like to be able to make decisions on allowing her to travel with another driver for things like the mall, parks, shopping for her, or other situations during my visitation hours. My current visitation is on Tues eve from 5:30-8:30/9pm and Sunday from 10-2pm. All she keeps saying when I tell her I'd like to look into this is that it's not gonna happen and no judge in the world will give me more visitation with my past. I just don't know what I should do or if anything is even possible in the future. Thank you for any advice or assistance in this matter.

    You want to do babysteps on this.

    Start off with the visitation you currently have and the transportation options you currently have and use those without any negative incidents for three months. Don't miss any visitations and make sure you are completely punctual on pick up and drop off times.

    In any interactions with your ex-wife, be completely polite. I would suggest voluntarily telling her what your plans for visitation are, then sticking to those plans. If you end up doing something other than what you planned, tell your ex-wife about it when you drop your daughter off.

    If your ex-wife has remarried or has a boyfriend, do not get into any arguments or fights with him.

    Do very well with your existing visitation, then start planning for an increase in visitation. If you immediately get into a dispute over visitation as soon as you finish your incarceration, you'll confirm every prejudice the judge may have against you because of your DUI history.
