    Post Charged With Domestic Violence After Grabbing Arms to Stop Slapping

    my room mate a girl and i were drinking and we got in to a disagreeemnet and she started slapping me after being hitting me 2 or more times i grabed her arm to stop her she got a bruse and called the police she told them she was the agressive one and not to take me ...iam being chaged with domestic violance ,,,she has wrote the court and prasacuting attorney telling then i didnt do any thing and that she was slapping me and i tryed to stop her ...what can i do here in Michigan to get them to drop the charges

    "Disagreements" don't cause bruises. People don't call police when their roommates aren't "doing anything". The problem is that she notified police of an incident where both sides say they laid hands on each other. She's got a visible injury. She can let the prosecutor know her feelings about the case, but they prosecute on behalf of ALL of society, not just the immediate victim, and it doesn't matter what she writes to the court - the court hears matters in the courtroom. The state has EVIDENCE of a grab hard enough to leave a bruise. Why WOULD they drop such a case? (Juries understand bruises). Police (and juries) aren't used to dealing with cases where the aggressor is the one to call police - that's usually what the victim does. Your defense is that you were protecting yourself. To have your best chances of succeeding with that defense, you're going to want the services of a criminal defense attorney.

    Aardvarc is right. The only thing to do now is let this play itself out in court. If you are adamant that you did nothing wrong, I suggest you talk to a lawyer and take it to court. Bruises are pretty convincing. I have been attacked by a woman myself. I had to grab her wrists to stop her from hitting me as well. The biggest differrence is, I did not leave bruises. You did some pretty good grabbing buddy. So, good luck. But, it sounds like your grabbing had a little more anger and frustration than it did just protecting yourself.
