My question involves an eviction in the state of: New York
I live in New York City. My subtenant's sublease terminates August 1, 2011. I have a 2-month security deposit from my subtenant.
The subtenant is, as of June 2, refusing to pay her last two month's rent. She said that I should use her deposit in lieu of her rent money. The subtenant has done substantial damage to the apartment - she painted the walls that need to be painted back to white and broke a doorknob. Additionally, she ruined a pan (I witnessed this) and may have stained my rug. I asked that she split the cost of these damages with my second subtenant. She is refusing to pay for the repairs to my rug and pan, stating that I cannot prove she did it, and says that she will repaint the walls and repair the doorknob before she leaves.
I am concerned because 1) she may do further damage to the apartment before the sublease ends, 2) there will be unpaid utilities at the end of the sublease, and 3) I have no guarantee that she will in fact make the repairs that she has agreed to make.
I have been able to find a great deal of information for landlords evicting tenants in New York City, but there is little to no information on how to evict a subtenant. I would be very grateful for any information.
