    Default Moving Out Due to Cockroaches and Mold

    My question involves landlord-tenant law in the State of: PENNSYLVANIA

    I recently received a promotion and an opportunity to live in center city in an apartment that will be the same price but the quality will be better for my health & living standards among other things.

    First, I called my landlord today to secure a copy of my lease for my personal records, she starts asking me all these personal questions about my roomate and i (if we had a falling out, if she wasn't living there anymore) questions that frankly I found unprofessional. She acted like me asking for a lease was a burden for her.

    Needless to say, my lease was a one year that automatically rolled over. My new apartment is available to me July 1 so I will still technically be responsible for (July 1-January at my current apt.) This was no big deal as I was going to pay both until my lease was paid off and cut my losses.

    Until I realized many things that I have overlooked.

    I live in a bonified FLOOD ZONE. I was not told this prior to moving it, it has since flooded about 2 times to the point of evacuation and potential for rescue boats, that is not in my lease what so ever and has only been added to leases this current year. I was not told about the flood zone & I'm not sure anything can be done because I did not bring this up as it was happening.

    I have roaches, they say it's due to uncleanliness, but I've looked at the other apts in my building and the roaches are inhabiting in the walls, they show up everywhere, I've had the maintenance men spray numerous times including hundreds of dollars out of my own pocket but this is a building wide problem not an apartment specific problem

    There is mold! When the apartment complex floods not only does it flood my basement but I did a mold test. I'm thinking about doing another mold test because mold came up in major numbers, I've been told that they never properly clean up the mold when it happens they just 'paint over it,' real healthy!!!

    There are/were racoons in the attic which I told them about once they said they took care of it and they came back, I havn't heard of them recently however, I'm sure there is feces and urine up there among other things.

    Someone help, I'm 25 years old and would cooperate with my landlord but I feel all in all I have been taken advantage of beyond my means. It's one thing to pay for a cheaper apartment its another thing for an apartment to be substandard and unhealthy.

    Regardless, I am moving in a month, I'm waiting on a copy of my lease, with all thats specified above I know that I may still be liable for the remaining 6 months of my current apartment I just wanted to know if there was anything else I could do. Thank you so much for your help!

    I don't know of a requirement in any state that a landlord warn tenants of potential natural disasters. When I first saw a flood zone map for the city in which I live I was surprised to see that 2/3 of the city is in a "100 year" flood zone, even though only small areas have flooded in recent memory.

    If mold testing shows toxic mold, you will have potential remedies based upon the presence of toxic mold. Most mold is not toxic.

    If you had raccoons and they're gone, they're gone. Speculating about additional issues doesn't translate into something upon which you can take action - speculation isn't evidence.
