    Default Required Documents for H1b Petition in Which the Spouse Doesn't Need H4 Sponsorship

    I was asked by my employer to turn in a copy of marriage certificate, proof of my wife's previous H status, current I20 and paystubs, and her passport, I-94 and more.

    I looked through form I-129 as well as the supplement forms and the form does not state any thing about this requirement at all if the spouse/dependants do not need H4 sponsorship. Are these documents really required? Will my petittion be rejected if the documents are missing?

    You were asked for this information by your employer. If you do not believe your employer needs the information, ask your employer why they want it. If you want to know what your employer will do if you do not provide the documents, ask your employer. We're not your employer and do not know its intentions, motives or policies.
