    Default Didn't Recieve Items or Refund

    My question involves a consumer law issue in the State of: Ohio

    I'm mostly wondering if I even have a case.

    I saw a listing on Craigslist for some furniture for sale. I decided to go look at it and possibly buy it. At the time I believed I was about to move into an apartment that my aunt was renting. So I went and looked at the furniture, and I thought it was well worth the $200 asking price, so I went to the bank to get the money, came back and paid for it. They offered to deliver it but I hadn't moved into the apartment yet so I asked if the could hold it for me for about a week, which they agreed to do. This was Thursday, May 5. I'm in the National Guard and I had drill that weekend. While at drill i found out my aunt didn't want to rent the apartment until July. So when I got back I went to an apartment complex and applied for an apartment. I was waiting to hear back on when I would be able to move in before I called the people I bought the furniture off of to give them a timeline. During this time a few things happened, my dad was hospitalized, then I was, among a few other things. I lost track of time and suddenly it was three weeks later, so i decided to call the sellers back to see if they held on to the furniture. I assumed they decided to hold it for me since they had my number and I had not heard back from them. Unfortunately they had got rid of the furniture 8 days after I bought it, (because she said we agreed they would hold it for 7 days, which we did not. I asked if they could hold it for about a week, expecting them to be at least a little flexible), as they were "not a storage facility." When I asked when I could come pick up the $200 I was told I "obviously" wasn't getting it back.

    The way I see it, when I paid for the furniture, it was my furniture. Now the law may disagree as to when the furniture actually became mine. I'm upset that I don't have the furniture, but was willing to accept that it was gone and take my money and try to find a similarly good deal. I was even going to give the sellers $50 for their troubles. But now I am without furniture and I'm out $200.

    So is it reasonable to expect a refund or did I screw myself over by not contacting them within 7 days?

    They don't get to do both - they either give you the furniture, or they refund your money.
