Default Handicap Parking Violation New York

My question involves a traffic citation from the state of: New York

I received a ticket for parking in a handicap space of a private lot. There were no above ground signs posted and the markings on the ground were faded. When I backed into this spot at dusk, it was not clear it was a reserved space. Please see the picture below.

My question is, does there need to be an above ground sign posted in order for it to legally be considered a handicap space? What are the requirements of a handicap space in New York?

I want to know what my chances are of fighting this ticket, because I do not believe it is justified.

I would appreciate any help or advice.

I'll give you a hint. Host your image on a site that doesn't contain malware. Nobody wants' to risk their computer to answer your question.

Malware? I've never had any issues with imageshack. Perhaps maybe you should update your antivirus software.

Anyway, here is a second source:

I would appreciate any help here.

    I think you're in luck:

    2. (a) The parking spaces designated pursuant to the provisions of this section shall be clearly identified for use by handicapped persons which designation shall include conspicuous and permanently installed above grade signs which display the international symbol of access and which shall be positioned from the parking space surface at a height of not less than five feet nor more than seven feet and may include the use of blue painted lines or markings. Such parking spaces also may be marked as tow-away zones.

That's one of the most poorly marked handicapped spaces I have ever seen...

EXCELLENT! That's exactly what I was looking for. Thanks bruin!

I'm going to arrange a hearing -- I'm interested to see what the outcome will be. I will be back with an update.

You're welcome. Next time though, avoid parking in any questionable parking spot to avoid the hassle (i.e. faded red curb, green curb, etc).
