    Question Family Violence / Assault Charges

    Ok, so about 2 or 3 days ago me and my ex-bf/babys father got into a huge fight while he was driving us back home. He was calling me ugly names that i dont think is appropriate for me to put on here. So he proceeded to tell me ugly things and i slapped him, he then punched me in the face causing for him to bust my lip and i bled from my nose and lip. So I lost it. He had hit me many times before but i never did anything back. Not this time i started to hit him back and he would hit me back and it went on back and forth. I then called the cops but he grabbed my phone and broke it in half. This man following us saw what had happened and i made a sign for him to call the cops, so he did. A while later they stopped us and arrested my ex bf and told me to follow them so they could get statement. They ended up arresting me too cause he recorded me on his phone saying that i hit him cause he had hit me or something like that. So my question now is what can i expect of this? i have court on august 24th and i want to know what might happen. can i get jail time? thanks.

    What will happen is you will have to enter a plea to whatever it is that you are charged with--sounds like domestic battery or assault. My best guess is jail time is a possibility but not a probability if you have no prior record.

    no my record is clean until now. but my ex bfs record is a mess..will he get jail time? so if my record is clean then theres a possiblility that i wont get jail time? maybe probation?

    If your ex has priors then his situation is altogether different. On your case if you plead or are found guilty probation with conditions, probably counseling, is a possibility--depends on the judge.

    I would recommend getting an attorney because he/she can contact the prosecutor and work out a deal that may very well involve no jail time so you don't show up in court not having any clue as to what will happen.
