    Default Drainage from Neighbor's Basement

    My question involves real estate located in the State of: New York

    Our neighbors have their sump pump and washer drain out of their basement window into our yard and driveway. It has started to ruin our grass and leaves mud and puddles in our driveway. We have asked them to move the pipe but they refuse saying that the pipe is on their property. I'm not sure what to do from here with them or if I have a case or not. I really hate dealing with the mess in the summer and the ice in the winter. My kids can't even play in our driveway because of this.

    You can look into whether their set-up is a code or ordinance violation that might be enforced by your local government. If not, your remedy is to try to sue them for damages and/or injunctive relief - and for that I would suggest teming up with a real estate lawyer.
