My question involves a traffic ticket from the state of: Wisconsin
about a month ago i was invovled in an accident and was cited with a ticket for failure to yield while makign aleft turn.
the intersection that the accident happened at was a 4 way intersection. traffic going north and south had a stop sign where as traffic going east and west was a through street (had no sign). i pulled up the the intersection heading south and stopped at the stop sign, put my directional on to head east (left turn), when i arrived at the intersection there were no other vehicles there so i took the time to roll the window down on my truck (it has manual windows) and get a ciagarette out. when i looked up from getting my cigarette out of its pack a car was opposite me at the stop sign heading north and they were going straight so i went to go through the intersection so as not to hold up the other driver any longer. the other driver must have thought i wasnt going so they pulled out too and our vehicles struck about in the middle of the intersection. the front right corner of my truck hit the other car in the middle of the hood on their car.
now it is to my understanding that at an intersection it is pretty much 1st come 1st serve. i have tried to find a wisconsin statute/law in regards to who has right of way in this situation but everything i find refers to if 2 vehicles arrive at an intersection at the same time. i did find in the wisconsin dot motorists handbook where it cites that at a 4 way stop the driver that arrived 1st goes 1st but that is as close as i have come
please help, did i have the right of way or should i just tuck my tail and take the fine from the city?
