I was wandering if anyone has dealt with child removal from DFCS. My ex has had a case against her for almost a year now and she still isn't complying with the case plan. My daughter is 5 and is currently on a safety plan having to stay at ex's parents. I have been suppoenad to go to court in 5 days and don't know what to expect. I would love to have custody of my daughter but have not been financially capable of obtaining a lawyer.
The DFCS case worker on her case called me to explain that if my ex doesn't agree to the case plan then they will take custody of my daughter from her.
My questions are: What are the chances in them taking my daughter the day of court? Are their any documents such as a visitation record that need to be brought to court? What will be expected of myself and my current wife to do (such as will we have case plans)? And also if they decide to take my daughter is it possible that this will be a permenant placement or temporary?
I have applied for legal aid I just haven't heard from them yet and I only have 5 days to prepare.
