    Red face Changing Father's Name on Birth Certificate in Virginia

    I need to change the father's name on my daughter's birth certificate. She was born in Virginia. We live in North Carolina, the father listed (my ex) filed the papers stating he is not the father. Her biological father has signed the papers stating he is the father. What do I need to do to get her last name changed and the correct father's name listed.

    What do you mean by "filed papers" and "signed the papers"? What papers? Where and how were they filed?

    He went to a lawyer and they filed the papers at the county courthouse in North Carolina that both men signed. Stating I am the father / I am not the father. I had a copy of it at one time. I know that I can go to the courthouse and get copy of it. I can't remember the title of paper.

    It sounds like they did a dis/establishment of paternity, Have you havd aDNA test to prove who is the father?
    The man claiming to be the father mar petition the court to amend the BC with your consent the name cna be changed, What about child support? Has that been changed?

    I am married to her biological father. We have not had a dna test done. She is his spitting image. Virginia may require it. I am trying to find out what process I need to follow.

    You will have to file to amend the BC in the state where the child was born and follow those statutes, & you better get a DNA test.
