    Default Charged with 3rd degree theft - I didn't do this!

    I am 21 years old, I live in Washington State, and I have never ever been in any trouble at all... this is my first offense.

    I was charged two days ago for theft 3rd degree. The thing is.. I did not commit this crime I am being charged for. I was in a park with my boyfriend and his brother, and some kid had lost his bike and told the police that I stole it and rode off on the bike. I never saw these kids or their bike, so I think they just happened to see me from a distance and just blame it on me.These kids have no proof that I committed this crime and after the police had put me in handcuffs, the kids didn't even identify me at all. I NEVER saw these kids.

    I was arrested and put in the back of a police car. A few minutes later, they let me go but wrote me out a ticket that says I have to appear in court in 6 days. I have no idea what to expect to happen in court.

    Does anyone know what I need to do in advance? Do I need an attorney? And also does anyone know what exactly will happen when I get there?

    Any information would be greatly appreciated as I am very new at all of this stuff. Thanks to anyone who replies.

    Yes, I'd say you need an attorney. Something seems way off here. Your attorney, who would be familiar with the discovery process, can find out information about the case from the prosecutor. When you show up for court you will just want to make sure you plead not guilty and request a trial date if you have not retained an attorney by that time.

    Ok, I was planning to get an attorney, but I don't think I will get one for the plea on Tuesday. I guess I will just arrive, the judge will call me up, I will plea not guilty of course.. since I'm not guilty.. and then he will give me a trial date. Depending on what happens, I will probably get an attorney.

    That's what someone told me will happen... But hopefully the kids and their parents will realize that they don't have any evidence on me and that it is just my word against the boy's, and the whole thing will be dropped. I have witnesses saying I didn't take the bike anyway, and that boy has nothing...

    Not to sound exceptionally cynical, but there's a scene in one of the "Grumpy Old Men" movies where Burgess Meredith says something to the effect of, "Wish in one hand, crap in the other. Guess which gets filled first."

    Don't count on this being sorted out without a trial, and certainly don't count on anybody suddenly seeing the light and asking the prosecutor to dismiss the charges. I suggest consulting a lawyer sooner, not later.

    Thanks for your input.. I was just being hopeful because I am truely innocent. I know you all probably hear that a lot.. people saying they are innocent who really aren't.. but I didn't have anything to do with this crime, I just happened to be in the wrong place at the wrong time and the boys decided I did it. They have no proof and I know they can't convict me of this if it goes to trial, so I hope it does. And I have been looking into getting an attorney ever since this happened. I don't have the money for one though, as I have learned through all the consultations, so I will have to get a public defender.
