    Default Renting a Room to a Parolee

    My question involves criminal law for the state of: California

    I understand when renting a room to a parolee that the police/parole officer has the right to search common areas and the parolees bedroom. *Do they have the right to search locked rooms such as other bedrooms and an office room? Also, the parolee in question has agreed not to have a house key, so if they are outside the locked house when the owners (my wife and I ) are not home, can the police/ parole officer forcibly enter the home?

    It's difficult to tell what your concern is here. If you're concerned that a parole officer might find contraband in your home, it would be sensible to either not rent to somebody who is on parole or to first get rid of the contraband. The parole officer's search of other rooms would depend upon the parolee's access to those rooms and the expectation of privacy of other tenants. I'm not going to speculate about "what if's", without knowing the facts that might lead to the parole officer both making a home visit and being aggressive about searching the premises. If there's probable cause for a search, after all, the parole officer can stand outside the locked door while he calls his colleagues to get a search warrant.

    Let me see if I can elaborate. I have never been in trouble with the law nor I have anything to hide, but I don't want any one rummaging through my personal belongings, number one; and number two, I don't want any one in my house, especially searching through my things if I am not home. The renter is going to be my son, otherwise I wouldn't have a parolee living with me. If you have ever seen the way the police go through a parolee's residence you would know what I mean. They have no respect.

    So my question pertains to my bedroom, office and additional guest rooms that will have and be locked when we are not at home. My son will not have access to them when we are at home. Also, if we are not at home he will be somewhere else and not have a key to enter the house.
