    Default Improper Lane Usage

    My question involves an injury that occurred in the state of: Louisiana
    I was coming down off a bridge which comes down to a red light. I was in the far left lane but needed to move over the right. While sitting at the red light, I had enough room to merge the front part of car(past the passenger door) in front of a truck that was sitting at the light. He was upset because he didn't won't to allow me in. He then in turn hit my car from passenger door up to the front bumper forcing my car back into the left lane while both cars are stuck together. Ok, I understand I got a ticket for improper lane usuage but can't understand why the other driver is not accountable because he could have prevented the whole accident. Plus, he had his daughter in car and claim she was injured. Any suggestions for when I have my court date because I plan to fight it?

    Was he still moving when you entered his lane? You say "enough room" but how much room was in front of him before you cut him off? Were there any other vehicles in front/behind/next to either of you?

    In all honesty, I cannot believe that he wasn't charged with something more than a traffic violation... but... to suggest that "he" could have prevented the whole incident when in fact, YOU cut in front of him FIRST and HE hit your car SECOND.... isn't making a lot of sense to me!

    What are you trying to fight at your court date?

    You were issued a summons for a traffic violation (improper use of lanes).

    If the officer saw you cut the other driver off he would have issued a summons regardless if there was an accident or not, making the accident another matter.

    The only weight the ticket carries is the fact that it makes you "at-fault" for the accident.

    Are we talking about a large commercial truck or a pick-up truck/SUV?

    If it were a commercial vehicle it wasn't that the driver was upset and didn't want to let you in, it was because the driver couldn't see you. Your car is too small and low to the ground. If you were to sit in his truck with your car right in front of it, you wouldn't see your car. This is why the officer sided with the truck driver. You are 100% at-fault for cutting in the path of the other vehicle.

    We both told our stories to the state trooper. We were not moving at the time I entered the lane. We were at the light. It was a pickup truck. I know for a fact he saw me.

    Bottom line, you entered the other drivers lane. You have a duty as a driver to hold your lane until it is clear to enter another lane. When a vehicle is right next to you at a traffic light, that lane isn't clear for you to enter.

    If the other vehicle was in the lane next to you, but was at the traffic light a block behind you, then that would make it clear to enter the lane next to you.

    You cut the guy off, what more is there to explain?
