    Default Telephone Harassment

    My question involves criminal law for the state of: Tennessee

    I've sifted through the forums and legal definitions, etc. but I would like some outside opinions on this question.

    Yesterday, I received a cell phone call from a number that was unknown to me. I wasn't able to answer it because I was at work. About 4 hours later, I attempted to call it, and no one answered.

    Up until about 10 pm, I made a total of 6 calls (not in a row). On the last attempt, I had a hunch that it was my soon to be ex wife. I "spoofed" my number to make it look like it was from an area code that her fiance lives in. She answered, I asked who it was, and she said her name. I told her who I was, she asked me if I got the divorce papers, and we hung up. No hateful words were exchanged.

    I had also sent 3 text messages, one asking who the person was. 2 telling my wife that she needed to get her lawyer to move his lazy ass and get on the ball with the divorce, and that she wasn't getting any money from me.

    No threats were made (other than me telling her I would file for default). No further calls were made or will be made. She has never told me not to contact her. There has been no history of any type of violence.

    My question is, is/was this harassment on my part?

    As a simple rule of thumb, odds are if you believe that your conduct could constitute harassment the person at the other end will also have that impression - and it's time to back off and communicate in a responsible, respectful manner. Your ex- has a lawyer; consider getting one yourself and keeping the contentious stuff at a lawyer-to-lawyer level.
