    Default Confused As to What My Charge Actually Is

    My question involves criminal law for the state of: Indiana

    I was arrested for domestic violence and for three months now I've assumed I was charged with domestic battery, well today I looked at my papers and it says "The Defendant has been convicted of the crime(s) of: Class A Misdemeanor Battery. Does that mean I have a Battery charge and not a Domestic Battery charge? If its just battery can I possess a firearm? I ask because I would like to join the Army. Any info will be greatly appreciated thank you for your time.

    does it list a statute or code number along with that statement?

    Not for my charge but for the no contact order there is.

    Indiana code IC 35-42-2-1 is Battery

    Indiana code IC 35-42-2-1.3 is domestic battery

    either can be charged as a class A misdemeanor.

    If the no contact order was pre-conviction, it may not reflect the charge you were eventually convicted for. So, the only thing I can suggest is either contact the lawyer you had, if you had one, or check with the actual court records. There should be an accurate code section recorded in the court records.

    I didn't get the no contact order until after I plead guilty, which I regret doing I didn't know I was giving up so many rights by pleading guilty. Thank you for your time I really appreciate it.

    One of the correction officers told my mom that I got lucky and the charge was lowered to something else. So it could be possible it was lowered from domestic battery to battery.

    At least in Illinois, your FOID card application questions if have been convicfted of battery to a domestic partner. Which could be partner, relative, roommate. If you answer yes(which you should if applicable,) it can exclude from a firearms owner's id. At least temporarily.
