    Red face Minor Name Change in North Carolina

    My question involves name change laws in the State of: North Carolina

    My daughter is 9 years old, and I have been married to my husband for 6 of those years. When she was born, I didn't list a father on her birth certificate. She has had little contact with him, and none in the last 3 years, he has never had custody, nor has he ever paid child support. I'm sure if I asked him, he would consent to the name change since she has my maiden name, but I don't know if I can get in touch with him. I worked in the legal field for a few years, but only in personal injury/WC/SSD cases. How do I go about starting the process of the name change? Can I just have him write a statement, notarized, that he will give up all rights, and is okay with name change? Can I get the name change form off the internet or do I need to request at a courthouse? Any advice would help! Thanks!

    Name Change of a Minor Child (Under 16 years of age)

    A minor child's parent(s) or legal guardian may file an application to change the minor's name. However, the name of a minor child may not be changed without the consent of both parents (if living), unless no father is listed on the birth certificate and the child has not been legitimized by the father. If there is no father listed on the birth certificate, the child must be at least one year old to complete the name change and a Birth Certificate issued within 30 days of the name change request. (One can always request an updated Birth Certificate from Vital Records (Click here: http://vitalrecords.dhhs.state.nc.us/vr/index.html) If you are unable to obtain the consent of an absent parent, you will need to consult competent legal counsel to help you with the name change. Neither the ten (10) day Notice posting nor Affidavits of character are required for name changes of a minor child. Please bring the birth certificate and identification of the parents.

    I didn't clarify, I meant the surname... wonder if this still applies?

    I didn't specify that I was talking about changing her last name to my husband's, wonder if this info is still applicable?
