    Default Accused of Disorderly Conduct by a Retail Store Employee

    My question involves a consumer law issue in the State of: Pennsylvania

    I just received a call from a police officer in the township where the mall is located. An employee at a chain children's store was demoted over a complaint that i called in. She is now filing harassment charges and disorderly conduct charges against me.

    Here's the story...it's ridiculous!! I went in to the store. Had a large purchase. Realized I forgot the coupon that they gave me (for being a frequent shopper). Asked the employee (who was a keyholder) to hold the items until tomorrow, so I could pick them up, with my coupon. She said no, policy is not to hold overnight. I said, oh ok. Do you have a coupon that I can use? She said Nope. If you go to the pharmacy to pick up a prescription, and you forget the actual rX, do they give it to you? (irrelevant, but i chuckled anyways).

    So, I said fine, I'll buy the items and bring the coupon in tomorrow for a price adjust. She said nope, not allowing you to buy them.

    So...the next day, I called their corporate office, the district manager called me back, and apologized profusely. Said they would handle it, and had she just asked the DM, they would have approved either giving me the code for that day or holding the merchandise until the next day. I assumed it was done and over with. Placed the order online, and moved on.

    Until this morning, when I got the call that the employee is filing disorderly conduct charges and harassment charges against me, stating I threw a pen at her....which I did not. I used their pen to write down her name and left it on the counter.

    I called the DM, who was horrified and had no idea this occured. I'm a wreck. I have no clue what happens next...except that the police officer is mailing me paperwork, and i'll have to go to district court, if i plead not guilty (which I will be).

    I think there will have to be some witnesses on her side for the charges to stick.

    I am very surprised she got demoted based on you asking the DM about the store policy etc unless you made it sound worse than you are actually telling us here.

    Maybe there was a camera in the store that can prove you did not throw the pen.

    The employee could get in further trouble for filing a false police report.

    If you did not throw the pen, I would not worry too much, just prepare a defense. See if there was a camera in the store. You have not been formally charged yet. The police are still fact finding.

    She was downright rude to me, with her tone...which is what I told the DM. And the DM sided with me, and kept apologizing on behalf of the company. And today, when I talked to the DM, she said that they demoted her based on her performance and conduct. She said that when you are a keyholder, you are expected to make decisions that help a customer, not upset a customer. I would assume it was based more on that, than my complaint alone.

    The officer said that another employee in the store was there, but did not witness everything. She witnessed me write down the name, but didnt see the pen being thrown. She did know that I was upset as well, and heard me say that I was calling corporate to file a complaint. The officer provided me very little details. I asked if I could call him back for more information, and he said no. Does that seem odd to you?

    I have a feeling in the end you are going to be fine.

    The employee is just inconveniencing you as revenge. These tactics usually backfire and she could end without a job and with no U.E. benefits if she isn't careful.

    I wouldn't worry about it.

    The employee is getting back at you.

    For what it is worth, I would have already fired the employee that gave a customer such terrible customer service and then had the cojones to FILE A POLICE REPORT when that customer complained.

    Thank you for reassuring me...

    I'm doing my best not to worry, but gosh, I really really am. I can't believe this is happening to me. It's so stressful to me!! I called the corporate office, and they told me that while they don't agree with her, she filed those charges as an individual, and that they have no overall control over her as a person, which I understand. At that rate, I still would have fired her...but that's just me.
