    Default I Have a Fully Illegal Fiance, a Baby, and I'm Trying to Join Air Force

    I have been with my fiance for over two years, she has been my comon-law spouse(in nevada) for what will be two years in July, which means she's been living with me, been my significant other, and performed the role of a housewife since. We now have an 11-month old baby girl, and we're both 18. I want to make her my wife, but I have to do it soon because I plan on joining the Air Force in order to support her and our baby, but I really want to station in Japan which means she must have a passport, and that means she must be a citizen. She is fully illegal, she didn't come to the US with a visa or anything like that. She first came to the US illegally with her parents when she was 5years old. I read that if you are an illegal alien tha wishes to marry to become a citizen, that you must leave and return to your home country for 10 years as punishment before you can request for a status change. The problem is I truly love her, and we can't afford to wait that long, our daughter will be 11 years old by then.
    I also heard about a more affordable way to do it, but it sounds sketchy and I want to learn more info before I jump at it and end up doing it worng. I read online(website similar to this one) that you an go to you're fiance's home country, go to her home town/state and go to the Ameican Consulate or something like that to brig her back the legal way to it'll take less time to file and be more affordable as well. I don't know though, I never heard of such a thing. And would I have to get married to her here in the US or in Mexico? I heard something about going to the Consulate first and then having to marry her within 90 days. Please help me out, our future depends on it and we really have no idea what we're doing, at this point we can'r afford to consult a lawyer about it.

    Doesn't matter - NV doesn't recognize common-law marriage.

    You cannot afford NOT to have an attorney.

    It will take - even after marriage and even if she's allowed to become a permanent resident - at least 3 years before she will qualify for citizenship.

    You also have a problem I'm not sure you have considered - the age of consent in NV is 18. You have a child of 11 months. This indicates that you were engaging in intercourse before you turned 18....and while it wouldn't generally be stat. rape, either or both of you could be convicted of contributing to the delinquency of a minor. (Unless you both turn 19 in a few weeks... )

    The proof is the baby.

    First things first, know that you have little to no say where you are stationed in the Armed Forces when you are fresh out of basic. You are more likely to do a tour in the sandbox first time out than getting a plum overseas assignment. Once you have some years under your belt, you might get lucky. Recruiter promise you Japan? Don't take it as gospel, those things change with the needs of the service.
    Second, you may have a difficult time getting any job specialization that requires a security clearance with a girlfriend who is an illegal. Not saying it's impossible but may make things more difficult. You may be peeling spuds for a living.

    I can pretty much guarantee that the recruiter promised the world starting with Japan!

    This is partly how my #2 ended up joining the Reserves....

    ..and is now currently in Afghanistan.

    As to the whole citizenship thing, she's going to have a very tough time even with a lawyer. Trying to play by the rules in order to get married does not impress CIS.
    There is no such thing as common-law marriage in most states these days. A few do still allow it, or recognize those from before the laws were changed, but NV ain't one of them as Dogmatique pointed out.
    Has she tried contacting the consulate for her country of origin to see about getting a passport through that country to travel to Japan? Just be warned that if she were able to do that, you might have to live on the economy due to her status as a foreign citizen.

    You've been living together for 2 years - how have you been supporting yourselves?
