I expect the defense would be that the money she was trying to obtain was her own. You don't appear to be disputing that some of her money was stolen (apparently you're separated?) and apparently the police found sufficient cause to believe that you committed the theft that they arrested you.Quoting Mississippi Code § 97-3-81. Robbery; threatening letter demanding money, property.
This was because you don't want to sign the documents necessary to end your divorce? So... you want to remain married to this woman?
i am fighting the divorce in mississippi...she is having an affair but all of that is neither here nor there...i went to pick up the kids one day and she said i stole the cash...i did not but the charges were filed...but before the charges were filed or even the accusation was brought forth she told me i had 24 hours to sign the papers or she would file the charges...i was advised not to sign them and allow her to file the charges on me...no she has no proof and no case but when i am found not guilty i want to know what i can due to pursue action against her
You will be free to ask the police to investigate her for possibly trying to set you up, or whatever it is you're alleging. I won't promise that they'll be interested in pursuing the report.
trying to see if it was a crime to threaten me to sign the papers or she would have me arrested....the arrest is not the question because she actually did it....but the inital threat was either you sign these or you will go to jail....i did not do what she alleges but that is not the issue..i will be found not guilts and then hit her for malicious prosecution...i am trying to see if there is a blackmail or extortion charge somewhere as well....
Why don't you read what people are posting? The statute has been provided above.
