    Default My Apartment Would Not Accept My Money Order for Rent Because It Was 5 Days Late

    My question involves an eviction in the state of: Indiana.
    now they want to evict me and i have to go to court on may 25th. they are suing me for 894.00 for lawyer fees and court costs and whatever. can this happen and what do i do when i go to court?

    If you can't pay the $894.00, then prepare to be moved out by May 26th.

    If you are late in paying your entire rent (even if you've paid a portion of it on time), then you can be served with an eviction notice for the amount of outstanding rent. Fail to make good on the 3-day notice, and the unlawful detainer goes forth. Every state has different laws about the minimum grace period for payment of rent; for example in CA, rental units have a mandatory minimum 3 day grace period (not late until the 4th), and for mobile home park spaces it is a 6-day grace period (late on the 7th). If your minimum grace period (and what is in your rental agreement) is less than five days, then yes, you can be evicted.
