    Exclamation Daughter Caught Shoplifting at Walmart

    My question involves criminal law for the state of: California. My daughter was caught stealing $30 in merchandise. I was in line. She was at the door. I couldn't see the event. She is 14 years old. I adopted her when she was 10. She is mentally/emotionally disabled. The store employees scared her to death. She was alone with them for a few minutes before I got there and went into major anxiety attack. I signed what they said was a Restitution Agreement and would cost approx $50. Just got a Settlement Offer. They want me to pay $250. This is absurd. My daughter is receiving a consequence at home. I don't see why I should be punished. I'm thinking of sending $100 with a letter explaining the above in more detail and telling them that's all I'll pay. Advice?!

    A long time ago 1970's when we got caught shoplifting, we were released to our parents and no restitution or criminal charges were filed. Doesn't mean the police were not called as they were or it wasn't serious as it was.

    Today is a new modern world and shoplifting is not tolerated as much anymore. Loss from theft weighs heavily of a companies earnings. It is a very serious offense and you could end up nude during a search for more possible items from theft. Your daughter could have been brought to juvenile criminal court and you would have incurred greater costs and a juvenile record.

    $250 is quite lenient and as her guardian should be responsible for her until a certain age. For every person caught, quite a few get away. Had you daughter shoplifted items prior no one knows about?

    You could write a letter (better yet, have your daughter write the letter) and see if they buy it.

    If your daughter has the difficulties you say, they you'll have to try better to keep her within arms reach or closer to you. The loss control personnel were just doing their job and thankfully nothing physical occurred.


    Time to sit down and have a talk.
    I see this a lot with parenting were the parents don't look to future problems the child can have and then discuss them. There is a long list of things the child can learn from an informed adult who has had the past experiences.

    Any good child can steal; with all the children out there having neat colorful flashy gadgets, its easy for a child to be envious and grab on from a store that does billions of dollars of sales thinking no harm is done.

    Now I see why almart is messing with its prices all the time to get even with us but no excuse to shoplift.

    Should I ever stoop to shoplifting and get caught, I would be delighted to pay $250 for a clean criminal record.

    If she is mentally incompetent then she would likely have to pay nothing. Is she? $250 dollars is pretty standard fair ... You are not being punished, its your daughter's bill, not yours...have her pay it.
