    Default Price Tag Switching, Charged as an Accessory

    My question involves criminal law for the state of: Utah

    2 weeks ago my girlfriend and I were shopping at walmart. I switched a price tag from a $6 item on to a $12 item. When we paid for everything 3 people came up and told us that we were caught shoplifting. Obviously denied it. They told us if we came with them and cooperated they would not call the police. I literally just finished a professional program to work in healthcare, i basically wanted anything but the police to arrive. They said they witnessed me switch the tag and they were positive she was aware. She completely denied awareness and honestly I dont think she did know. We signed their stupid forms (no choice really) and left. Now we both have letters from bennet law telling us we owe $200 each and bla bla the standard letter that i've read about 100 times on this forum.
    My question is: What are my options really here? I actually wouldn't mind paying the $200 to have it go away. However, she really should not have to pay. Can I make them prove that they have any objective evidence of this crime? It seems like a stretch that they would, particularly enough to prove that she was aware of the situation. Thank you for any help!

    You pay or you find out what evidence they have at the potential civil trial that may ensue. They have no obligation to you before then. The odds are stacked against her if she admitted it on those "stupid forms."

    Those "Stupid forms" - one is likely ad admission of guilt.

    As for the civil demand:
    Don't pay. They send you another letter - for a larger amount. Don't pay again - another letter, for an even larger amount. Don't pay this one - they take you to Civil Court. Then, if you still don't pay, you get a red mark on your credit report which will make it hard to find an apartment, buy a new car, get a credit card.....

    Sorry I was a bit angry when I posted, although I know it was completely my fault. Turns out, the item I put the price tag on was 31 cents cheaper than the price tag I put on it.... So I would have actually been paying them extra? What now?

    Looks like $6 less not 31 cents more. Are you saying there was a unannounced sale that after all the work you did, it rang up 31 cents more than it would not have replaced the $12 tag with the $6 tag?

    So the item was actually on sale for $5.69 cents and you did not know it?

    Right thats what I originally thought. This was the price not on clearance. We didn't have to sign the "never return to walmart form" so we went back in to investigate. On clearance the item was 5.69
