My question involves criminal law for the state of: OHIO
Back in 1998 my husband got into trouble and served 5 years probation without getting into anymore trouble. This past friday night/early saturday he was pulled over after work for a routine traffic violation and searched when the cop became suspicious and that's when the cop found a rolled up dollar bill and he was then charged with drug paraphernalia to the 4th degree. I have no idea if the dollar bill had been used or not but it was confiscated. He wasn't arrested he was just given a carbon copy of his ticket and a copy of the paperwork with his DP charge and tomorrow he's to appear in court. We do know that he's looking at a fine of atleast $250 for the DP but nothing more. This would make him a repeat offender but we have no idea what to expect tomorrow and it's been atleast 11 years since his last offense. We're hoping that the judge will take into account that we have 2 small children that I care for and that my husband is the only one working. But any information would be helpful. Thanks.
