    Smile Name Change for a Minor in Texas

    My question involves name change laws in the State of: Texas

    My son is 4 years old and his biological father is not in his life, has never met him. When I gave birth to my son I gave him his bio fathers last name because the bio father was supposed to make an effort to sign the the birth certificate. That never happened.

    I'm now married and I'm trying to get information on where to start to change my son's last name. What documents do I need? Do I even need the bio fathers consent since he is not listed on the birth certificate? Do I have to go to court to get this done?

    Any info will be gladly appreciated. Thanks.

    You would petition for a name change, with notice to the putative father.

    Why aren't you considering stepparent adoption?
