    Default Subtenant Signed My Lease to Change Utilities

    My question involves landlord-tenant law in the State of: New Mexico

    I signed a lease for the house that I live in, I had a couple of people move in about a month later, I tried to change all utilities from the previous person's name, but I was told I couldn't do so without I signed leave (which i didn't have with me at the time).

    My roomate is a student, I work full time. He said he would have these utilities turned on and he signed the blank space on my lease contract (for a second tenant). I got my copy back but he made copies. My landlords did not make an agreement with him; only with me.

    I want him to move out because our personalities are not compatible as roomates. Does he have rights as a tenant or as a subleasee? How can I evict him?

    Are you stating that he found your copy of the lease, added his name to your copy, but that the landlord's copy is unchanged and the landlord has taken the position that you are the sole tenant?

    No, I was naive and trusting and just gave him the lease to sign so he could change the utilities, not so that he could be added to it with the same rights and responsibilities as a co-tenant.

    I recently told my landlord about what happened, but the landlord has absolutely taken the position that I am the sole tenant regardless of what occured with the lease copy.

    oh and yes, the landlords copy remains unchanged.

    Does this make sense?

    The landlord and I don't have a written agreement for me to sublease but he has verbally indicated that was ok. He knew they were moving in, but didn't get into a contract with them. I have no written contract with my subtenant.

    Ask the landlord if he can make you a copy of the unaltered lease, give your roommate formal notice to quit consistent with your state's laws and, if he doesn't move by the end of the notice period, commence an eviction action.

    I asked a lawyer about this and he said that since he signed a copy of the lease, I might be bound to him as his landlord. Apparently this isn't true?

    You are his landlord. You're taking rent from him.
