    Exclamation Can a "Mother" Be Charged with Accessory After the Fact to Statutory Rape

    My question involves criminal law for the state of: NC

    A 16 yr old girl just months short of being 17 briefly dated a 22 yr old young man. He went to her mother asked her permission to see her only at the mother home while the mother and her partner were present and the mother was happy to do so as she knew he was a great guy. The Mother of the 16 yr old got ticked at the Mother of the 22 yr old man(as she put a halt to the situation as soon as she found out) and then threatened Statutory rape charges against him.

    Am I correct the Mother and the daughter can both be charged with Accessory after the fact to Statutory Rape? The parents of this girl allowed them to Cort under their roof.

    Also later the 16 yr old ran away and as I understand it because the Mother did not file unruly disobedient type of order on her daughter, therefor there is no substance to her claim of aiding and abetting a minor runaway as the 22 yr olds Mother did provide the daughter a bus ticket to a treatment facility only having her in her home long enough to shower and eat.

    Any thoughts on this from someone who knows NC Law???

    The age of consent in NC is 16 years old. Statutory rape does not apply as the girl can have consenual sex. Since the sexual relationship is not a crime, the mother has committed no crime.

    I love wise words and thank you for your time. I read NC laws and statutes but wanted to be clear in understanding as some seemed to be a bit conflicting. Again.... Thanks!

    Keep in mind that just because stat rape is off the table does not mean that there no charge at all that can be placed against the 22 year old.

    If the adult encouraged the minor to "runaway", disregard house rules, provided alcohol or access to pornography could result in contributing the deliquency of a minor.

    For starters, you and your son could BOTH be sued in civil court for tortious interference with parental rights. (See LaGrenade v. Gordon, 1983) for inticing a minor child to leave a parent legally entitled to custody of that child (such as by providing a bus ticket). You could count on compensatory damages to start in the tens of thousands of dollars (you'd likely eat mom's attorney and court fees too), and punative damages to start at many times that. There is also the possibility of criminal charges for custodial interference (see NC statutes under Chapter 14-320), Contributing to the Delinquency of a Minor (see 14-316), and others as already mentioned. In other words, even with ALL of the sexual elements off the table, this minor child is under the parental control of her parents, and the laws, both civil and criminal, work in mom's favor to keep it that way until the minor reaches the age of majority.
