    Default What to Do After a Homicide, Commited in Self-Defense

    My question involves criminal law for the state of: California

    I was raped when I was 15 by my step-father in Mexico. I moved to the states and later heard that he had dead. About two weeks ago, a strange man started hanging around my neighborhood and I recognized him as my step-father and it turns out that his death was only a rumor. A couple days ago, he followed me in his car out of town and I confronted him with a handgun and told him to never come near me again.

    Tonight, he came into my house while I was alone preparing for some dinner guests and threatened to hurt me. My husband came home while this was happening and saw him and so my husband hit him with a metal candlestick which killed my step-father. He didn't mean to kill him and after checking the body my step-father didn't have any weapons on him.

    A couple of my close friends who were to be my dinner guests came in the house and saw the body and helped us hide the body in a trunk in the living room. I'm panicked now and don't know what to do. Since my step-father was probably already listed as dead, can we just get rid of the body somehow and pretend this all didn't happen?

    I obviously don't want my husband to go to prison, but I'm worried the police might not consider this to be self-defense since my step-father didn't hurt me tonight and wasn't armed. Please help as I'm really scared!!! Can I go to a attorney and tell him what happened or will he report it as a crime?

    and you should be worried. First, you brandish a firearm (was it even a legal weapon for you to carry) and threaten an unarmed man and then your husband kills an unarmed man and you hide the body. Good luck explaining that one as accidental.

    and since his death was a rumor, just where do you think he is listed as dead?

    and you need to worry about you and your 2 friends going to prison as well. You are all guilty of very serious crimes.

    This just sounds ... well ... too bizarre to be true.

    On the off chance that this is not a put on, I would recommend you and your husband contact the police, and then an attorney ASAP. That body will soon rot, and you and all your friends may well be complicit in a large assortment of crimes.

    If he was threatening you in your home then you and your husband may well have utilized reasonable force in self defense. The longer you wait, however, the more guilty you and your guests will seem.

    Still ... something just seems fishy and unbelievable about this tale. Killing someone, dinner guests hiding a body, and then getting on line to post to the internet where your IP address can be traced!? This can't be real ... or, you, your husband, and your dinner guests are all made of stiffer stuff than most people.

    Nice to know I was right ... it did sound like a play or TV plot.

    Oh, and I would recommend you not post that crap again. And do not be surprised if the Mods jump in as a result of this little deception.
