    Default Landlord Is Claiming A Lot Of Damage

    The landlord from the house I just moved from is claiming that I damaged many things that I did not. He has kept my security and is saying that I owe him more every week. When I gave him my 30 day notice he did not come to inspect the residence to see it was not damaged at all. Now that I have moved it is my word against his if this goes to court. I'd just pay without questioning to keep this torture from continuing except that I live on a very low income and can't afford what he's asking. My question is since I never agreed to pay a specific amount to him could I pay him some small amount every month and have that be legally acceptable?

    Default Pennsylvania Security Deposit Law

    It is my understanding that in Pennsylvania, within 30 days after a tenant moves out, the landlord must give to the tenant a written list of any damages the landlord contends were caused by the tenant, and refund the security deposit less the cost of the repairs on the list. (Reasonable wear and tear does not count as "damages".) If the landlord does not meet that requirement, the tenant cannot be sued for any damages the landlord claims that the tenant caused. In addition, if the landlord does not give the tenant the required notice, and fails to return the security deposit, the tenant may sue for twice the security deposit.

    If you have a check-in list, or witnesses who can attest to the condition of the apartment when you moved in, you may be able to defend against any false or exaggerated claims by the landlord.

    If you want to work out a private deal with the landlord, you might be able to pay off the claim in installments. If the landlord takes you to court, it is possible that the court would grant a periodic garnishment order against your wages, which translates into a payment plan of sorts.
