My question involves search and seizure law in the State of: Virginia.
While being pulled over by a loudoun courty sherrif I am asked if he can search my vehicle, I respond with 'no thank you.'
After the officer runs my identification and registration he approaches my window and proceeds to tell me to roll up all my windows and turn my vehicle off. (the beginnings of a routine k-9 search)
During the search, made by a second deputy from a separate vehicle, the canine repeatedly climbs onto my vehicle in multiple areas. Thus scratching the paint of my vehicle.
Concluding the search, no evidence was found and I was free to go.
The Freedom Of Information Act has gotten me the dashcam footage of the canine scratching around, but I am now wondering where this needs to be taken to be reimbursed for the damage caused by the dog. I am also curious as to the conduct an officer must follow during a routine k-9 investigation.
