What do you mean by a "notice to vacate" - are you simply talking about, for example, a notice to start the eviction process such as a three-day notice for nonpayment, or are we talking about an order of eviction at the end of the eviction process?
The house I live in belonged to my parents who have both passed away now. I have a brother who is in prison for the rest of his life and he is trying to force the sale of the house. I was served with an unlawful detainer and was given 45 days to vacate
and on the 6th of May I was served with a notice to vacate by 5/11. Also attached to the notice was a writ of possession of real
property.
Well, it's now 5/12, so you either moved out or you didn't, and they either acted on the writ or they didn't. What's happening?
Well so far nothing has happened but the day is not over yet. I found something on the net that said to file an emergency motion to stay the notice to vacate because it would be a hardship on myself if the notice was to be enforced at this time. And the reason for the hardship would be the fact that I am unemployed at the moment and have not found a place to live. Additionally I have 5 dogs and a cat that I have to find good homes for. Well make that 4 dogs because I will most likely end up keeping one.
