    Default Can a Non-Attorney Execute Small Succession in Louisiana

    My question involves estate proceedings in the state of: Louisiana

    Hello,

    My brother passed away without a will in March and left a $2000.00 life insurance policy as his only asset, the beneficiary of which was my father who passed away 4 years ago. The insurance company states since no alternate beneficiary was named, their liability for the policy is to my brother's estate. Since this is only $2000.00, and the paperwork for a small succession is simple, can I avoid the attorney fee for a small succession by doing the paperwork myself and having it notarized, or does the law require an attorney to do this?

    I don't see a requirement that you use an attorney for a small estate proceeding. See Louisiana CCP Sec. 3421 et seq.

    Ok, thanks. Sorry for late reply. Didn't get e-mail notified. During the interim, I went to the Clerk of Court to inspect several small succession documents. They appeared to be quite involved, usually 4 or 5 pages even if assets were little. Doesn't look like something I could easily write without help. I contacted an attorney and he stated a small success would cost $600.00. Yesterday, I received an "Affidavit Concerning Adminstration of Estate of Decedent" from the insurance company. Could you tell me if I would be required to file the small succession before I could submit this notarized docment to the insurance company or is that document all I would need to obtain the proceeds of the insurance? I'll contact the insurace company and ask but I do not have high confidence in what the reps on the phone tell me.
