    Default How to Remove Spouse from Vehicle Title

    My question involves a banking matter in the State of: PA
    I financed a car in my name for my husband. His credit stinks and he was not able to get a loan. The dealership put his name on the title as well as mine. But now we are getting divorced and I have both vehicles. I want to sell the one I got for him. He will not sign the release for me to do this. My question is this: his name is no where on the loan contract with the credit union, but is on the title. I tried to get them and the car delearship to remove his name they will not fix the title. Since he is not on contract at all does the credit union have a secured interest in this vehicle.

    He will not sign the release for me to do this.
    This needs to be addressed in the divorce process. The judge can order so.

    what does the contract with the credit union say? Is there a lien on the title?

    are your names listed without a conjunction; with: and; or with: or between them?

    I don't have the title copy but I'm guessing it is an AND.
    I talked to them yesterday and they stated he should have signed the contract, even though he did not. So their security interest is only with me. They called the dealership and they are not willing to correct the title. Do they have a perfected title? I work at a bank and this would never happen here. Because if we repo'd the vehicle we could not sell it since the joint person on title did not sign. Otherwise we would not have a proper security interest in the vehicle. The dealership told me they used to do this all time with the Credit Union, but the credit union had some issues and no longer will accept the papers without both names on all docs.
    I would love to be able to afford an attorney, but I can't. Basically by not wanting to turn the vehicle in and wanting to not ruin my credit I am getting screwed.

    If they have a lien recorded on the title, then they have a lien recorded on the title. There is no reason why they cannot lend to only one of two owners, although if they do so I would expect them to have the co-owner sign a release authorizing them to repo and sell the car, and apply the proceeds to the loan, in the event of default.

    do they have proper security interest? He will never sign for them to sell car, he won't sign for me to get rid of car by selling it.
