My question involves a traffic ticket from the state of: Florida. Today I received a ticket for not wearing a seat belt, when in fact I was. I honestly believe it was the vantage point and other mitigating circumstances that prevented him from seeing.
1. He spotted me from the passenger side in pretty high speed traffic traffic (50-60 mph), while he was standing by his motorcycle on the side of the expressway. I was at least 3-4 lanes over.
2. The car is black, with a black interior (significant fact).
3. I was wearing a long sleeve white shirt (significant fact).
4. At the time I was on a conference call (using Bluetooth hands free unit of the the car).
5. I talk with my hands and was probably waving the right hand up an down.
6. When he approached the car on the passenger side, from the back, he was cautious and slow. I had already let the window down. As he cam into speaking distance, I asked why I was pulled over "was I speeding". He said no you are not wearing your seat belt. I was in extreme shock and showed him that I was. He then said not when I saw you back there. (please note that he had just said I was not wearing at the time, then change the reference from present tense to past tense)
7. He just kept insisting that I was not wearing it.
8. He then stated that "Sir, you are wearing a white shirt and your seat belt is black. I know what I saw."
Now to be honest, from his vantage point that could have been the case. Remember, I said that I was wearing a long sleeve white shirt and talk with my hands. I was possible for my forearm to have been up at the time he felt that he saw no black belt crossing my shoulder and chest area (i.e. the forearm blended an obstructed the view). Also keep in mind that the interior of my car is black. Therefore, the upper part of the belt would have blended into the car's interior.
I have great respect for officers and know they deal with a lot and people lie to them all the time. I pay my tickets and since being a kid, never felt that I even the need to dispute a ticket. This is truly about principal. I was doing what was right, yet got a ticket for it. The office had zero patience and attacked my character. This really bothers me.
If I were to challenge this, do you believe I stand any chance? I believe I can show circumstantially, that I must have had my seat belt on. I have the time and duration of the conference call I was on. The seat belt alarm would have been an extreme annoyance in such a situation. All this in addition to the other details.
