"Statutory rape" isn't an actual charge. The actual charge under statute will depend on the EXACT ages of BOTH parties involved. There are different charges (at misdemeaor and felony levels) depending on those numbers. Possible actual charges include things like aggravated sexual assault, predatory criminal sexual assault, criminal sexual abuse, and aggravated criminal sexual abuse. Those charges carry penalties anywhere from 3 to 30 years in prison in IL.
