    Default Children's Home Environment

    My question involves a child custody case from the State of: Ohio
    My childrens primary residence is with their mother. We were never married nor do we have legal custody set up. Considering the environment they are subject to: mom does drugs, drinks alcohol, brings men into the home on a regular basis, oldest daughter is pimping herself out, middle daughter is being homeschooled, doing drugs, drinking alcohol and her boyfriend (appx 17 yrs) is allowed to live with them, and most recently her son, 11 yrs, just put a knife to his older sister and went to court over this incident. I am very interested in getting them out of this environment and raise them myself. What do you think my chances of winning full custody with or without supervised visitation might be? Their safety and welfare is of paramount concern of mine. Children services have been called but was told we couldn't followup. Any words of advice would be grateful.....

    What PROOF do you have of any of this?

    Why did child services not act?

    This is information that is passed onto me by my children in addition, her middle child has a twitter acct and posts regarding the drug use, alcohol, bf and the latest incident with the knife. Children services was called anonymously.

    If child services have investigated and found no reason to remove the children, you'll have a hard time changing custody unless you can show a change in circumstances.

    And really - kids lie. A lot. And they lie even on their online social networking sites!

    You would need solid evidence - not just your kids' word.

    I read various articles that indicate social media can be used as evidence in a custody case. And in the case of my children, they are 5 and 3. I'm inclined to think they are not making up stories. Regarding the knife incident, I was able to verify the info on a public site, that is another reason I am believing my children when they tell me in such details that a 5 and 3 year old wouldn't even begin to know how to make up such things.

    You missed my point.

    CPS have investigated and found no cause for concern. So, you have to show a change in the children's circumstances. It may be even more difficult since you don't have any form of custody at all right now, and Mom has status quo on her side.

    By all means speak with a local attorney who can guide you further, and who will know the local climate of the courts.

    Edit: Dad, why haven't you filed for shared parenting yet? Weren't you doing that in Feb?
