    Default Military Disability Payment Count As Income in Regards to Child Support

    My question involves child support in the State of: NY

    My ex husband receives a disability payment monthly from the VA does this count towards his income in regards to child support calculations? is there a law that states this?

    i think they can try to take it if its his ONLY source of income, but i've heard its been argued due to the fact that VA are unassignable according to US Code 5301.

    sorry...i meant it can be argued that va BENEFITS are unassignable.
