    Default Paid for the Car in Full but Didn't Get the Title

    My question involves a consumer law issue in the State of: Utah

    I recently bought a car from someone, we each signed a Bill Of Sale, I paid the full amount using a cashier check, and the seller promised to mail the title the following week. I took the bill-of-sale to the DMV and had the car registered in my name.
    After I took possession of the car, the seller wanted me to go in on a weird tax evasion thing where he would claim to have “traded in” the car to a dealer and we claim to have paid the dealer instead so that he doesn’t have to pay taxes on the new vehicle he buys. When I refused to go in on this, he got very offended. He did not give me the title yet and he will not return my calls. On the bill-of-sale we wrote down that he has 15 days to produce the title and we all signed. What should I do if I don’t get the title at the end of 15 days?

    We finally got a call back from him. Now he claims that we are harassing him because we called him 4 times in one week since he got mad at us. He threatened to call the police on us if we ever call him again.

    Having that we are in a middle of a business transaction with him, is this possible? What should I say to the cops if they show up at my door?
    How long should I wait before I sue him?
    Should I sue him for the title or for the money back?
    Can I add the attorney fees to the claim if I was to sue him?

    He doesn't want you to contact him by phone, so don't.

    Do you think he's going to produce the title? If not, I don't see a reason to wait.

    There's no point in suing him for the title - if he had the title he would transfer it to you and you wouldn't have to sue him. If he acquires the title while your case is pending and you want the vehicle, you can have him title the vehicle over to you and dismiss your case.
