    Default Attorney Fees in Case of Dismissal

    My question involves collection proceedings in the State of: California

    The atty representing me in a cc debt collection case (dismissal requested by plaintiff followed discovery request) is asking for payment as if the case was settled or a judgment issued. The agreement does not mention compensation in case of dismissal, only after "settlement or full and final judgment". I don't believe they are entitled to anything, of course.

    You don't believe they deserve to be paid for the work they've done? Is that what you're saying?

    And a dismissal IS the final judgment in that case. That case has been dismissed, that's the end of it.

    pay the guy. You expecting him to work for free is ridiculous.
    Gee, maybe there is a pattern here considering you were being sued for failing to pay a debt

    Wow, such vitriol. I did pay his $200 fee for the discovery request and the plaintiff's response was to request dismissal. Do you still believe I owe any more?

    how is anybody here supposed to guess what kind of time or even his rate? Nor does anybody here know what he did or anything about your contract with him.
