    Default Can HOA Tow Car Under No Other Pretense Than Vanity

    My question involves personal property located in the State of: California

    I've been storing a 1969 Buick on my fathers driveway at his house. The car is covered with a car cover so all you can see are the wheels. HOA is threatening to tow over nothing more than the fact they think it looks unattractive. I know CA has had new towing law for private property to make it harder for people to tow.

    What do the HOA rules say about cars on driveways?

    Yes, I know it sounds absurd, but there are new subdivisions with HOAs that dictate even what kind of car you can park in your driveway.

    I'm not sure I don't live there any more, I understand completely that HOA have insane bylaws that can be enforced, but I also know that they are overridden by state laws. I was just wondering if there was some sort of state law that would not allow them to legally tow me without recourse.

    For example in the DMV link I sent it says that any one who wants to tow something off private property has to either be their or have an official agent of theirs at the time of towing to fill out info on the car, if they don't the HOA is liable for more than the towing fees.

    What did the HOA representative say about the tow? What did the tow company say?

    It really does hinge on the exact wording of the by-laws. If the by-laws forbid car covers such as you describe, they may well be able to force you to move your vehicle elsewhere. That you are not a resident of that community poses an additional hurdle for you.

    (Questions like this strengthen my resolve to NEVER live anywhere with an HOA.)
