    Default Closing an Estate Without Resolving Inheritance Division

    My question involves estate proceedings in the state of: Kentucky

    When there are serious issues between two inheritors on agreeing how to handle inheritance (keeping joint ownership vs. dividing property), is it okay to go ahead and sign papers so the estate can be closed with the thought (on one side) to resolving those issues later? Or, would that complicate matters for the inheritor who wants to divide the property? Are you personally more liable as a joint owner than you are when the property is still in the estate? Is your spouse placed in any kind of liability situation when you are joint owner? Thank you.

    If the estate can be closed consistent with the estate plan, then it can be closed even if the heirs haven't decided how they're going to handle their jointly inherited property.

    You aren't responsible for property you have not inherited. Your liability for inherited property will depend upon the nature of the property and the facts.
