My question involves unemployment benefits for the state of: California
On my claim form about a month ago I marked YES on the box "Did you BEGIN any school or training" on one of the weeks' columns. I started school that takes place at night. I have class from 8:30 to 11:30 at a audio engineering trade school. I purposely chose that school schedule as it would not interfere with any possible interviews or employment. I stated this during my scheduled interview. The woman interviewing me was so completely rude and a friend that was with me even stated how insane it was that she spoke to me in such a way. I was completely calm and sweet during the interview and answered all her questions. I then received a letter of Determination that stated:
Date Mailed: 04/26/11
"You are not willing to accept employment because you are attending or plan to attend school. After considering available information, the department finds that you do not meet the legal requirements for payment of benefits. Section 1253C provides - an individual is eligible for benefits in a week only if the department finds he was able to work and available for work."
I have since sent in my claim form that was sent along with the above determination and my appeal letter. My question is, I have been on unemployment before while in school full time and they never denied me benefits. Why now? And how can they deny me in the first place if I stated during my interview very clearly that my school schedule is flexible and full time employment takes precedence either way! Also how long until I get a response? I sent my claim form as well as the appeal form that following Monday, May 2nd.
