    Default Drug Charges from 20 Years Ago and Getting Section 8 Housing

    My question involves criminal law for the state of: New York

    My questions is can the state of New York charge me for a crime that i committed 20 years ago and can those crimes be held against me for section 8 housing in the same state?

    If the statute of limitations has not run on your crime, you can be charged with the crime.

    If you have a criminal record that affects your eligibility for subsidized housing, then that's the effect of your record.

    Difficult to answer, beyond what KIA said, without knowing more detail. Are you saying that you committed a crime 20 years ago, you went undetected and they now know it was you and are trying to charge you? Did they charge you 20 years ago and you never appeared to resolve it?

    The said charge was an bench warrant from an possession charge in 1990 found through an investigation by NY state Sec. 8 housing , details are faint on that time of the said called crime , was arrested and charge with possession of controlled substance , released and sent to rehab in another state and never returned to NY until 20 years later .. Police came to house ( sent by sec 8 investigator ) ran name and ID and haven't heard anything until yesterday , sec 8 president called to apologize for investigators conduct.? I believe statue of Limitations is 7 years for anything but murder , so we was told? So why am i being harassed for my stupidity as an youth in my adult years?

    To clear the facts...You were charged with possession in 1990. What happened to the case? Were you found guilty? Plea agreement to dismiss/reduce charge for a successful completion of drug therapy? Not guilty?

    If you were already charged for the crime then the SOL doesn't apply. If you failed to complete the mandatory rehab and report back to NY or send it paperwork, then the state can pursure the case to completion.
