    Default Are Disconnection Fees Legal

    My question involves business law in the state of: Nevada
    I pay for Satelite radio service,and have used the service since before 2008, but recently have not had the money to keep the service. I have stopped using the service before without being charged any fees and I have not signed any contract or any forms that I know of, but the company is wanting to charge me fees for disconnection of service and other fees that I do not think they have a binding agreement to do. Or do they have the right to charge these fees to any one who does not continue to use the service. I am very seriously thinking of going back to regular radio or maybe the new HD radio.

    What does your contract say about disconnection fees, and what is the purpose of the fee? To remove equipment installed to support the service?

    I dont have the letter in my hand at the moment, but as I recall because of non payment (Duh) It was a 3 month subscription payment to have the service... They disconnected my service. (Again, Duh) but I cant afford to keep paying every three months right now. I own the equipment, and there is no contract to begin with. I will find the letter to post more later in the week.

    Ok, so I found the letter "Bill" and I am being charged a previous balance, radio service fee late fees now, and a cancelation fee. They were nice enough to remove the "Service" fee of thiers before I got the bill. (This is different than the Radio service fee I am being charged). In the "Terms" in the bill, It states that because of my activation of the service that I have agreed to the terms and conditions. It goes on to say that "Any payments and/or credits processed, or charges incurred after the bill issue date will be included in the next billing. All services are billed in advance. Billing may include charges for a potential month of service based on the date service was activated." The paragraph abvove this states "Service may be deactivated for non-payment and deactivation fees may apply. Any past due amounts, including deactivation fees, must be paid before services will be reactivated. (No brainer there) Last statement in this portion of the paragraph states - "Terms and conditions describes all of these fees in detail" So, am I assuming that anyone company or entity can use this loophole to get more money from people? I never seen these terms and conditons and again there was no contract signed, but apparently just by having the service I agreed to all these terms. If so, and it is binding, I guess I have to pay them and then trash my satelite radio and use regular FEE FREE radio or maybe the new HD Radio.
