    Default How to Get Protection Against Retaliation at Work

    My question involves labor and employment law for the state of: Nev.

    I contacted my HR department on sexual harassment and discrimination charges against my supervisor.

    I'm worried that my employer will retaliate against me.

    Do I have to file a complaint with the eeoc to get protection from retaliation?

    I haven't filed a complaint with the eeoc yet.

    You don't have to but it would help any wrongful discharge case...if Nev. sees this type of activity as a public policy issue & they consider it a wrongful discharge.

    You said "you contacted" .. in writing? I would make it in writing any complaint such as this.

    You can report whatever you want, but you cannot get EEOC protection against something that is purely hypothetical.

    Retaliation for your making a report of sexual harassment and racial discrimination would be improper, with or without a prior expression of concerns about the possibility that it might occur.

    Filing the complaint with HR DOES give you "protection" against retaliation.

    Dear Javer, HR is your best protection and playing nice is your best protection. My honest advice is to not approach EEOC as you'll loose favor with your Employer. Unless you hire an Attorney (who constantly advises you, and bear in mind thats very costly) and then you are willing to put up a tough fight, do not do not approach EEOC as your life will be a perfect example of living hell.
