    Default Should I Pay Restitution Owed to Store Before Court or Wait

    My question involves criminal law for the state of: Pennsylvania

    I got caught shoplifting in a department store, the items valued a little over $200.00, the police were called but I wasn't arrested & all items were returned. I was told I would get a letter in the mail from the corporate office stating what I would have to pay the store for this incident. My question is should I pay this before I have to go to court & would this be the same as restitution?

    It's called civil demand. Paying it looks better than not paying it. No, it is not the same as court ordered restitution. Some courts will, if you have already paid the CD, not impose further restitution as the retailer has already been made whole but I don't know how PA court's handle that.

    Your Civil Fine will be the cost of the merchandise plus $150. When you go to court, it will help you if you say "Your honor I am sorry for what I have done, I have paid or am paying the company their civil fine."

    It just shows that you are remorseful. Not paying will have no impact on the court case, but paying can help you out.

    Pay it when you get the Civil Demand letter. take proof of payment to court.

    Thank you very much.....all of this information is really helping me ease my mind. They told me I should be receiving the Civil Demand notice within 7-10 business days, hopefully I get it before I get a court date.
